- Entrepreneur visa / residence authorisation (Ley 14/2013 arts. 69-72)1198 €We draft the application for foreign nationals who are going to start, develop or manage an entrepreneurial activity in Spain that is innovative and of special economic interest. It goes through the UGE-CE (Large Companies and Strategic Groups Unit) with a favourable report from the Directorate-General for Internationalisation or ENISA. - Residence for highly qualified professionals / Ley 14/2013 (Startups Act, Ley 28/2022)1077 €We draft the application to the Unidad de Grandes Empresas y Colectivos Estratégicos (UGE-CE, the large-companies and strategic-groups unit) under Ley 14/2013 arts. 71-72, as updated by the Startups Act (Ley 28/2022). - DAC7 Registration and Filing: Modelo 040 and Modelo 238 for Digital Platforms714 €A tax compliance service for marketplaces and apps caught by the DAC7 directive. We handle the prior registration in the register of operators (Modelo 040) and the annual online filing of the report on your sellers' or hosts' transactions (Modelo 238) with the Agencia Tributaria (Spanish Tax Agency).
- Residence for research purposes (Ley 14/2013, art. 72)472 €We draft your application for a research residence authorisation before the Unidad de Grandes Empresas y Colectivos Estratégicos (UGE-CE, the large companies and strategic groups unit), the route for non-EU academic staff with a research relationship with a university or centre: pre-doctoral researchers with a contract (Ley de la Ciencia, FPI/FPU), post-doctoral researchers, contracted lecturers and researchers with a hosting agreement. It is NOT an estancia por estudios (student stay authorisation): as soon as there is a contract or a hosting agreement, the correct route is research. It does NOT require homologación of your degree (unless it is a regulated profession), it allows teaching and simultaneous reagrupación familiar (family reunification). - Modelo de utilidad (utility model, minor patent)422 €We register your modelo de utilidad with the OEPM (Spanish Patent and Trademark Office) ("patente menor", minor patent). It protects technical inventions that give an object a configuration with an appreciable practical advantage. Faster and cheaper than a full patent: no substantive examination, 10 years of validity, ~6-12 months of processing. We check the requirements of worldwide novelty, inventive step and industrial application; we redirect you to a full patent if the object is a process, biological material, a chemical/pharmaceutical substance or a therapeutic method.
- International trade mark through the Madrid System (OEPM to WIPO)363 €We draft the application to extend the protection of your Spanish trade mark to multiple countries (134 members of the Madrid System) using the OEPM (Spanish Patent and Trade Mark Office) as the office of origin, with forms MM2/MM4. We identify the Spanish base mark, the Nice classes, the designated countries and any Paris Convention priority (6 months or less). WIPO basic fee plus a fee per class plus a fee per designation, plus the OEPM transmission fee. There is a 5 year dependency period (the international mark falls if the base mark falls).

Legal basis: Reglamento (UE) 2017/1001 + Reglamento de Ejecución 2018/626. Ideal if you missed the opposition deadline and the competing mark infringes your earlier rights or was applied for in bad faith, avoiding the high costs of the courts.

It protects technical inventions in any field (products, processes, chemistry, biotechnology), and lasts 20 years from the filing date. In Spain the substantive examination is not automatic: it has to be requested and its tasa (official fee) paid within the deadline (art. 39 of Ley 24/2015), and we take care of that. We check that the subject matter is not excluded under art. 4 of Ley 24/2015 (discoveries, abstract methods, computer programs 'as such', therapeutic methods) and that the three requirements for protection are met; if your invention is merely an object with a particular shape or structure and you would rather keep costs down, we suggest the modelo de utilidad (utility model), which we also handle. The grant is for the OEPM to decide: what we answer for is our work and the technical defence of the file.
- Application for revocation of a trade mark before the OEPM (Spanish Patent and Trade Mark Office) (Ley 17/2001 art. 54 + RD-Ley 23/2018)180 €Application for a declaration of revocation (caducidad) of a registered trade mark before the OEPM, through the administrative route of art. 54 of Ley 17/2001, which has been the Office's own competence since RD-Ley 23/2018. Grounds: no genuine use for five years (art. 54.1.a, the most common), failure to renew after ten years, the mark becoming generic through the owner's inactivity, the mark becoming misleading, or surrender. The burden of proving use falls on the owner (art. 39) and standing to apply is broad. We prepare the application, file it with the OEPM on your behalf and follow the case through to the decision. There is also a court route before the Juzgados de lo Mercantil (Commercial Courts) (art. 61): it requires a procurador (court agent) and is not included in this service.
- Registration of a trade mark assignment or licence with the OEPM (Spanish Patent and Trade Mark Office)180 €We register the change of ownership or the licence to use your trade mark or trade name. If you renew after the ordinary deadline has passed, we warn you of the applicable surcharge: 25 % during the first 3 months of the grace period and 50 % during the following 3 months. If more than 6 months have passed since expiry, the trademark has lapsed and we propose a new application.

- Right to erasure / right to be forgotten (GDPR art. 17)35 €We draft the request to the data controller so that you can exercise your right to erasure, also known as the right to be forgotten (art. 17 RGPD, the GDPR): data no longer needed, withdrawal of consent, objection, unlawful processing, a legal obligation, or data collected from a child. It includes a request that third parties be informed (art. 19) and, where appropriate, compensation (art. 82).
- Recurso de reposición (administrative appeal) before the AEPD (Spanish Data Protection Agency) (LO 3/2018 + Ley 39/2015)35 €We draft and file with the AEPD (Spanish Data Protection Agency) the optional recurso de reposición (administrative appeal), which must be lodged within 1 month, against a decision of the Agency: the shelving of your complaint, a penalty imposed on you as data controller or processor, an interim measure, or a decision on international case pooling. We also cover the correction of clerical errors (art. 109 Ley 39/2015). It includes a request to suspend enforcement of the contested decision (art. 117 Ley 39/2015) and notice of the early-payment reduction of 20% (LO 3/2018 art. 85). This is an administrative procedure: no abogado or procurador is needed. If you later decided to go to the contencioso-administrativo (administrative court) route before the Audiencia Nacional, that is a court procedure which requires a procurador and is not included in this service.
- AEPD: registration / notification of the Data Protection Officer (DPD)35 €We handle the initial registration, amendment, replacement or removal of your Data Protection Officer (DPD) in the register of the AEPD (Spanish Data Protection Agency), which is compulsory within 10 days of the appointment whenever RGPD (GDPR) art. 37 or LOPDGDD art. 34 applies.
