We process your visa or residence permit as an international teleworker (Ley 14/2013, updated by the Startups Law, Ley 28/2022): for people working remotely for companies based outside Spain, either as an employee (foreign employers only) or self-employed (up to 20% of clients in Spain). Which documents do you need?

  • •Employment contract or commercial agreements with the foreign company (minimum 3 months) and authorisation to work remotely from Spain.
  • •Proof of 1 year of real activity of the company (commercial registry or equivalent).
  • •University, postgraduate or business school degree, or 3 years of professional experience.
  • •Proof of income of 200% of the Spanish minimum wage (SMI) per month (payslips, contract, invoices or bank statements).
  • •Seguridad Social (Social Security) coverage certificate (if there is a bilateral agreement) or full health insurance.

Legal basis and things to bear in mind

  • Legal framework: Ley 14/2013 (arts. 74 bis to 74 quinquies), added by the Startups Law (Ley 28/2022).
  • Durations: teleworking visa of up to 1 year; residence permit of up to 3 years, renewable for 2-year periods as long as the conditions are maintained.
  • Two different routes depending on where you are: from inside Spain the 3-year permit is filed before the UGE-CE and we file it for you; from outside Spain the visa is applied for at the Spanish consulate in your country of residence (art. 74 quater) and you must attend in person. The UGE-CE does not decide anything before the visa.
  • If you are a shareholder or director of the foreign company you will telework for, the file is delicate: with effective control (50% of the capital or more, or 25% with management duties) the employment route of art. 74 ter c) is closed and you must use the commercial relationship of art. 74 ter d), with a services agreement signed by another director, invoices and traceable payments covering at least 3 months. The UGE-CE refuses cases where the foreign company is a personal vehicle with no substance.
  • As an employee you may only work for companies based outside Spain; if self-employed, you may invoice clients in Spain for up to 20% of your activity.
  • Your family (spouse or partner, children and dependent ascendants) can apply at the same time or later through our Reagrupación Familiar Express for Talent Visas (express family reunification).
