We process your visa or residence permit as an international teleworker (Ley 14/2013, updated by the Startups Law, Ley 28/2022): for people working remotely for companies based outside Spain, either as an employee (foreign employers only) or self-employed (up to 20% of your activity with companies in Spain). If you are already in Spain lawfully, we file the residence permit of up to 3 years electronically before the UGE-CE, decided within 20 working days with positive administrative silence. If you are outside Spain, what you apply for is the teleworking visa of up to 1 year at the Spanish consulate in your country: we prepare and review the whole file, and the appointment and filing at the consulate are done by you (or by an accredited representative, if that consulate allows it). It is resolved in 10 working days. Once in Spain, the residence permit of up to 3 years is applied for within the 60 calendar days before the visa expires: do not miss that window.

Which documents do you need?

  • •Complete and valid passport (data page and stamps).
  • •Criminal record certificates from the countries of residence of the last two years, apostilled (apostilla) and translated, and a sworn declaration of having no criminal record in the last five years (we draft it).
  • •Employment contract or commercial agreements with the foreign company (minimum 3 months) and authorisation to work remotely from Spain.
  • •Proof of 1 year of real activity of the company (commercial registry or equivalent).
  • •University, postgraduate, vocational training or business school degree (homologated if your profession is regulated in Spain), or 3 years of professional experience.
  • •Proof of income of 200% of the Spanish minimum wage (SMI) per month, €2,442 a month in 2026 (€34,188 a year), plus the amount for each family member coming with you (payslips, contract, invoices or bank statements).
  • •Seguridad Social (Social Security): registration of the company or self-employed registration in Spain, or a coverage certificate if your country has an agreement with Spain; and health insurance with an insurer authorised to operate in Spain (registration with the Spanish Seguridad Social already meets this requirement).

Legal basis and things to bear in mind

  • Legal framework: Ley 14/2013 (arts. 74 bis to 74 quinquies), added by the Startups Law (Ley 28/2022).
  • Durations: teleworking visa of up to 1 year; residence permit of up to 3 years, renewable for 2-year periods as long as the conditions are maintained.
  • Two different routes depending on where you are: from inside Spain the permit of up to 3 years is filed before the UGE-CE and we file it for you; from outside Spain the visa (art. 74 quater) is applied for at the Spanish consulate for your place of residence, and it is filed in person, by you or by a duly accredited representative with a power of attorney if that consulate allows it. The UGE-CE does not decide anything before the visa.
  • If you are a shareholder or director of the foreign company you will telework for, the file is delicate: with effective control of the company the employment route of art. 74 ter c) is closed and you must use the commercial relationship of art. 74 ter d), with a services agreement signed by another director, invoices and traceable payments covering at least 3 months. The UGE-CE refuses cases where the foreign company is a personal vehicle with no substance.
  • As an employee you may only work for companies based outside Spain; if self-employed, you may work for companies in Spain for up to 20% of your activity. Any change affecting the conditions under which you were admitted, such as changing company, must be notified to the UGE-CE within 30 days (additional provision 7 of Ley 14/2013); in practice, the UGE-CE processes a change of company as a new initial application.
